Attracting and retaining the right employees and professionals has become a critical component of effective human resource management. Today’s marketplace for talent is truly global in scope, making immigration management an important and regular task for employers. Bressler’s immigration attorneys guide employers through the rapidly changing landscape of immigration law and we advise on the full array of immigration-related disciplines, such as:
Employers are required to file petitions for non-US citizens. We assist in preparing the required documentation and petitions for:
- L-1A visas to transfer executives and managers from affiliated foreign offices to the US
- H-1B visas for specialized non-immigrant workers
- O-1 visas for outstanding researchers, scientists, and artists
- TN visas for Mexican and Canadian nationals
We work with our clients on a variety of other business immigration needs, including business visas and intern/trainee visas. We also assist J-1 physicians in securing waiver of the home residency requirement and obtaining H-1B or O-1 visas to work for hospitals or other medical providers. When employers file petitions for work visas on behalf of foreign nationals residing abroad, we prepare those foreign nationals for the required interview process at both the US consulate and at the border.
We assist employers and individuals in filing the petitions and applications required to obtain permanent residence (“green card”). We guide our clients through each step, including the required advertising and recruiting practices for permanent labor certification and subsequent immigrant worker petitions. We also assist employees’ family members with derivative family-based visa applications.
Employers must ensure that their policies and practices are up-to-date and in adherence to US and state immigration laws. We assist human resource staff to develop proactive and comprehensive Form I-9 and E-Verify policies. We regularly provide advice regarding hiring and verification issues. We work diligently with our clients to conduct on-site Form I-9 audits, as well as represent their interests in any matters or proceedings before US Citizenship and Immigration Services officials.
