Working with accountants, investment advisors, trust officers, insurance professionals and other professional advisors, we assist with formulating a lifetime gifting plan, engage in asset protection planning, establish charitable foundations, as well as plan for possible disability using trusts and other vehicles. Our attorneys also work with business owners to ensure succession planning. We prepare business buy-sell agreements and cross-purchase trusts, as well as devise other types of arrangements for owners of closely-held business.
The firm represents executors, trustees and beneficiaries in the litigation of disputes relating to estates and trusts. We have done so in controversies involving the interpretation of wills and trusts, as well as challenging an individual’s mental capacity, including proof of undue influence. Our approach is to achieve our clients’ objectives in the most cost-effective and sensible manner, while understanding the sometimes overwhelming sensitivities involved in intra-family disputes.
We assist fiduciaries to administer estates and trusts. We advise executors and trustees on implementing wills and trusts, probate procedures, preparing tax returns, valuation of assets and rendering estate and trust accountings. We also represent fiduciaries, beneficiaries and creditors in court proceedings in the event a dispute is not resolved during the audit process. Our attorneys prosecute and defend estate related claims pertaining to ownership and creditor problems, alleged breach of trust, will/trust contests and fee controversies.
Our expertise is based on strong professional backgrounds and hands-on experience. Two members of our team are fellows of the American College of Trust and Estate Counsel, and another is a past Chair of the New Jersey State Bar Association’s Real Property, Probate and Trust Law section. We have also played an integral role in drafting and implementing a number of laws pertaining to trusts and estates.

We assist fiduciaries in administering even the most complicated estates and trusts. We advise executors and trustees on implementing wills and trusts, carrying out probate procedures, preparing tax returns, valuing assets and rendering estate and trust accountings. We are skilled with techniques that minimize taxes and costs in settling estates, and guide fiduciaries and beneficiaries in winding-up the decedent’s affairs. We take appropriate steps to ensure that fiduciaries are properly protected from potential claims arising out of their service, and represent fiduciaries when government agencies conduct examinations of the tax returns.
Many estate returns are ultimately audited by the IRS. We know first-hand what it takes to prevail before the IRS and to resolve tax controversy. Our attorneys advise clients not only regarding the legal aspects of preparing estate returns, but also throughout the review process. In many instances, we have successfully defended the valuation of illiquid assets that affect estate or gift tax liabilities. In the event a negotiated resolution cannot be achieved in the audit process, our litigators are equipped to undertake litigation before the United States Tax Court and/or Federal Court.
