Estate Planning and Administration

Giving you peace of mind.  Relieving you of the stresses associated with family problems.  Helping you plan for your family’s future.  These are the hallmarks of Bressler’s Estate Planning and Administration practice.  Our attorneys solve problems by applying technical expertise in tax law and multi-dimensional experience in dealing with the multitude of family situations.  The firm represents clients in a wide variety of estate planning matters, ranging from simple wills, to the most complex irrevocable trusts, to probate and conservatorship endeavors.

Our attorneys constantly work to ensure the transfer of wealth to the younger generations. We focus on the use of vehicles that afford the maximum degree of control at minimal cost.  Using both complex and simple planning techniques, our estate planning services include preparing wills, revocable and irrevocable trusts, special needs trusts, family limited partnerships, limited liability companies and charitable trusts.

Working with accountants, investment advisors, trust officers, insurance professionals and other professional advisors, we assist with formulating a lifetime gifting plan, engage in asset protection planning, establish charitable foundations, as well as plan for possible disability using trusts and other vehicles.  Our attorneys also work with business owners to ensure succession planning.  We prepare business buy-sell agreements and cross-purchase trusts, as well as devise other types of arrangements for owners of closely-held business.

The firm represents executors, trustees and beneficiaries in the litigation of disputes relating to estates and trusts.  We have done so in controversies involving the interpretation of wills and trusts, as well as challenging an individual’s mental capacity, including proof of undue influence.  Our approach is to achieve our clients’ objectives in the most cost-effective and sensible manner, while understanding the sometimes overwhelming sensitivities involved in intra-family disputes.

We assist fiduciaries to administer estates and trusts.  We advise executors and trustees on implementing wills and trusts, probate procedures, preparing tax returns, valuation of assets and rendering estate and trust accountings.  We also represent fiduciaries, beneficiaries and creditors in court proceedings in the event a dispute is not resolved during the audit process.  Our attorneys prosecute and defend estate related claims pertaining to ownership and creditor problems, alleged breach of trust, will/trust contests and fee controversies.

Our expertise is based on strong professional backgrounds and hands-on experience.  Two members of our team are fellows of the American College of Trust and Estate Counsel, and another is a past Chair of the New Jersey State Bar Association’s Real Property, Probate and Trust Law section.  We have also played an integral role in drafting and implementing a number of laws pertaining to trusts and estates.

Our attorneys recognize the core concerns and goals of our clients.  Whether our clients come to us for a simple will or trust, or need for more complicated wealth preservation planning, we implement solid strategies by listening closely to their concerns.  We are skilled in creating effective vehicles for achieving our clients’ objectives.  The character of the plans we effectuate are as unique as the individuals we serve.

We provide peace of mind.  We listen to our clients and counsel them in tackling complicated family problems.  We offer solutions aimed at planning for the family’s future.  We solve problems by applying legal expertise and years of experience to the multitude of family situations.

Our attorneys work to facilitate the transfer of wealth to younger generations. We achieve these objectives through the use of vehicles that afford the maximum degree of control at minimal cost.  Using both cutting-edge techniques and traditional planning methods, our estate planning services include preparing wills, revocable and irrevocable trusts and special needs trusts, and creating family entities and charitable foundations.

Effective estate planning is not accomplished in a vacuum.  We work productively and in tandem with our clients’ accountants, investment advisors, trust officers, insurance professionals and other professional advisors.  We formulate lifetime gifting plans, engage in asset protection planning, establish charitable foundations, and plan for possible disability using trusts and other vehicles.  We assist executives to gain maximum benefit from incentive compensation, and work with business owners to ensure optimal and orderly succession planning.

Our attorneys are ever mindful that the tax-efficient transfer of wealth is often the essence of a comprehensive estate plan.  Our broad client base includes executives, medical and legal professionals, business owners, investors, family patriarchs and matriarchs.  They are individuals who require effective strategies to transfer their property. Our legal counsel includes:

  • Wealth preservation planning
  • Business succession planning
  • Fractional interest transfers of business interests
  • Debt restructurings, asset liquidations and distributions

When clients are called upon to act as executors and trustees, our attorneys are available to provide varying degrees of guidance.  In the area of trusts and estate administration, we are known for our focus on legal counsel that is cost-effective and achieves our client’s objectives in the shortest period of time.

We assist fiduciaries in administering even the most complicated estates and trusts.  We advise executors and trustees on implementing wills and trusts, carrying out probate procedures, preparing tax returns, valuing assets and rendering estate and trust accountings.  We are skilled with techniques that minimize taxes and costs in settling estates, and guide fiduciaries and beneficiaries in winding-up the decedent’s affairs. We take appropriate steps to ensure that fiduciaries are properly protected from potential claims arising out of their service, and represent fiduciaries when government agencies conduct examinations of the tax returns.

Many estate returns are ultimately audited by the IRS.  We know first-hand what it takes to prevail before the IRS and to resolve tax controversy.  Our attorneys advise clients not only regarding the legal aspects of preparing estate returns, but also throughout the review process.  In many instances, we have successfully defended the valuation of illiquid assets that affect estate or gift tax liabilities.  In the event a negotiated resolution cannot be achieved in the audit process, our litigators are equipped to undertake litigation before the United States Tax Court and/or Federal Court.
