We represent clients throughout the country in complex, multi-party environmental litigation. Our experience includes contaminated properties and smaller private actions involving cleanups, ranging from contaminated underground storage tanks and discharges to manufacturing facilities. We are highly skilled in federal and state cost recovery and contribution actions, where our attorneys have served as common counsel for multiple defendants at CERCLA/Superfund sites throughout New York and New Jersey.
Our attorneys understand the regulatory challenges facing today’s businesses. Our Environmental team is uniquely qualified to overcome concerns pertaining to federal and state air, water, solid and hazardous waste issues. We advise on complex permitting and compliance issues, with particular expertise in ISRA compliance. We are experienced in administrative cases involving both federal and state regulatory agencies. This representation also includes oversight of environmental consultants and negotiation with environmental agencies concerning cleanup activities.
Bressler is at the forefront of regulatory initiatives involving the environment. Our expertise includes recent efforts by federal and state governments to recover damages from private parties for injury to natural resources. We defend clients in agency actions involving natural resource damages, advise our clients on their options for assessing and restoring injured resources and services, as well as negotiate natural resource damage claims with regulatory agencies. We continually evaluate legislative and judicial developments in environmental law and as it impacts our clients’ operations.
Our attorneys understand the environmental factors that can drive commercial real estate transactions. We offer exceptional capabilities in counseling and negotiating the environmental risks of business transactions, including due diligence requirements, allocation of environmental responsibilities, as well as oversight of post-closing obligations. We also advise clients on issues concerning the expansion, redevelopment and reuse of contaminated properties (Brownfields), along with the most recent agency initiatives concerning these specialized projects.
